PCS Intel's Christopher Price notes that Verizon Wireless' latest advertisement for the Motorola Q "shows the Q doing a lot of different things, including what appears to be streaming video."
"Problem is, this violates the Verizon Wireless smart device terms of service," Price writes. "Under Verizon's terms of service, no data card, PDA, or smartphone can stream video over the network. Standard Verizon phones are permitted however to stream video over Verizon's V CAST mobile video service. Such a service is not available on Smart Devices, such as the Moto Q."
This isn't the first time this has happened -- Price notes that a previous ad showed a Verizon HTC XV6600 streaming CNN... he says Verizon claims both ads show stored video being shown, not live streaming -- which, particularly in the case of CNN, doesn't make too much sense.
What this really indicates is the reality gap in Verizon's marketing efforts -- if you have to break your own TOS to sell a product, then maybe, just maybe, you should be updating those terms of service.
